Welcome to EcoWestern. By creating an Economic ID or using any EcoWestern service, including MatePC, Enfusion, EcoWestern Cloud Services (ECS), Azura, and eChat (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
1. Account Registration & Economic ID
To access the core EcoWestern ecosystem, you must register for an Economic ID (the single identity used across all EcoWestern products).
- Eligibility: You must be at least 13 years old to create an Economic ID. If you are between 13 and 18 (or the age of majority in your jurisdiction), you confirm you have permission from a parent or guardian to agree to these Terms.
- Responsibility: You agree to provide accurate, current, and complete information, and you are solely responsible for safeguarding your credentials.
- Prohibitions: Sharing, selling, or transferring your Economic ID is strictly prohibited.
- Third-Party Sign-In: If you use third-party authentication, EcoWestern is not liable for their data handling practices.
2. User Content & IP Ownership
You retain full ownership of all data, text, files, and media ("User Content") that you create, upload, or store within the EcoWestern ecosystem.
- License to Operate: You grant EcoWestern a limited license to host, process, and display your content solely as necessary to operate the Services (e.g., syncing, rendering, AI processing you initiate).
- No Training Use: EcoWestern does not use your prompts or User Content to train Azura or any other AI model, except with your explicit, separate opt-in.
- User Responsibility: You affirm that you possess all necessary rights for the content you upload and do not infringe on others' rights.
3. Prohibited Content & Acceptable Use
Use of the Services is governed by our Acceptable Use Policy ("AUP"), which is incorporated into these Terms by reference and is the authoritative source on prohibited content and conduct. Violations of the AUP are treated as a violation of these Terms.
EcoWestern maintains a zero-tolerance policy toward illegal, dangerous, and abusive material, including (without limitation):
- Child sexual abuse material (CSAM) or sexualized depictions of minors.
- Non-consensual sexual content or intimate imagery.
- Terrorist, extremist, or violent propaganda.
- Material related to illegal trade (weapons, narcotics, etc.).
- Malware, spyware, or destructive code.

4. Safety & Account Search Protocol
While we prioritize privacy, we enforce an Account Search Protocol to comply with legal obligations.
- Investigations: Searches may be triggered by verified reports of severe abuse or valid legal process (e.g., subpoenas, court orders).
- Consequences: If illegal content is confirmed, we will immediately terminate your account and report findings to the relevant authorities (e.g., NCMEC).
5. eChat & Communications
- User Liability: You are solely responsible for the communications you send through eChat. You may not use eChat to harass, threaten, or impersonate others.
- Moderation: We do not monitor private communications. We act on reported content: if a message is reported to us, we may review it to enforce these Terms or comply with legal obligations, but we do not proactively review or scan private communications.
6. Azura AI & Automated Systems
- Probabilistic Outputs: AI-generated content may be inaccurate or biased. Outputs do not constitute professional, medical, financial, or legal advice.
- No Default Training Use: As noted in Section 2, your prompts and content are not used to train Azura by default.
- User Responsibility: You are responsible for the prompts you submit and for independently verifying AI outputs before relying on them.
7. EcoBeta Program & Developer Analytics
- Beta Features: EcoBeta features are experimental and provided at your own risk. Use of EcoBeta requires enhanced telemetry collection, which you consent to by opting in.
- Developer Logging: Use of our APIs (including ECS) is logged for security, abuse prevention, and network reliability purposes.

9. No Cryptocurrency or NFT Support
EcoWestern does not support, integrate, or facilitate cryptocurrencies or blockchain-based financial products. Any claims to the contrary made by third parties are fraudulent and not affiliated with EcoWestern.
10. Payments & Subscriptions
- Merchant of Record: Paid subscriptions and purchases are processed by Paddle (Paddle.com Inc., Paddle.com Market Limited, or Paddle.com (Canada) Ltd., depending on your location), acting as an authorized reseller and Merchant of Record for EcoWestern. Your purchase is a transaction between you and Paddle, governed by Paddle's Buyer Terms and Paddle's Refund Policy.
- Refunds: As a general policy, EcoWestern does not offer refunds for change-of-mind or partial billing periods. However, refunds may be issued at our discretion for verified service outages or billing errors on our part. All refund requests are ultimately subject to and processed under Paddle's Refund Policy and Buyer Terms as the transacting party, including any statutory withdrawal rights that apply in your jurisdiction (e.g., the 14-day EU/UK/EEA withdrawal right).
- Free Tier: Core features are currently free. We reserve the right to introduce or modify premium tiers at any time, with notice.
11. Other EcoWestern Products & Conflicting Terms
Certain EcoWestern products or services may be governed by additional or supplemental terms specific to that product (e.g., a product-specific EULA, API terms, or usage policy). Where such product-specific terms exist and directly conflict with these Terms, the product-specific terms control for any legal matter concerning that specific product or service. These Terms continue to govern all matters not addressed by the product-specific terms.
12. Privacy & Regional Data Rights
Our collection and use of your data is governed by our Privacy Policy. You can exercise data export and deletion rights at any time via id.economic.net/id/outback.

13. Indemnification
You agree to indemnify, defend, and hold harmless EcoWestern, its officers, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms, (b) your misuse of the Services, (c) your violation of any law or third-party right, or (d) User Content you submit.
14. Termination
You may delete your Economic ID at any time. We reserve the right to suspend or terminate your account if you violate these Terms or our policies.
15. Limitation of Liability & Disclaimers
Disclaimer of Warranties: THE SERVICES ARE PROVIDED "AS-IS" AND "AS-AVAILABLE." ECOWESTERN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECOWESTERN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES. ECOWESTERN'S TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID ECOWESTERN IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.
16. Dispute Resolution & Arbitration
In short: Most disputes between you and EcoWestern will be resolved through individual binding arbitration rather than in court, and neither party can bring a class action. You can opt out of this section within 30 days of first agreeing to these Terms. Small claims court remains available to either party as an alternative.
Informal Resolution First: Before filing an arbitration demand or any court action, you agree to first contact EcoWestern support via support.ecowestern.net and describe the issue in good faith. Most disputes are resolved this way. If we can't resolve it together within 30 days of your notice, either party may then proceed to arbitration (or the applicable carve-out below). This step is a required precondition to filing arbitration.
Agreement to Arbitrate: You and EcoWestern agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except as set out below. EcoWestern will pay all AAA administrative filing fees for your claim, so you will not be charged a filing fee to bring a claim under this Agreement.
Carve-Out for Injunctive Relief: Either party may bring an individual action in court immediately (without the informal resolution period above, and instead of arbitration) to seek injunctive or other equitable relief for claims involving unauthorized access, intellectual property infringement, or misuse of the Services, where a delay could cause irreparable harm. Either party may also bring an individual claim in small claims court as an alternative to arbitration.
Class Action Waiver: You and EcoWestern agree that disputes will be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
Mutuality: This arbitration agreement binds both you and EcoWestern equally. EcoWestern is equally required to arbitrate claims against you, subject to the same carve-outs above.
Opt-Out: You may opt out of this arbitration agreement by emailing legal@ecowestern.net within 30 days of first creating your Economic ID, stating clearly that you wish to opt out of arbitration. If you opt out, this Section 16 will not apply to you, but the rest of these Terms will remain in effect.
17. Governing Law
These Terms are governed by the laws of the State of Maryland, USA, without regard to conflict of law principles. For any matter not subject to arbitration under Section 16, disputes shall be resolved exclusively in the courts located in Montgomery County, Maryland.
18. General
- Changes to These Terms: We may update these Terms from time to time. Material changes will be notified via email or in-product notice at least 14 days before taking effect. Continued use of the Services after changes take effect constitutes acceptance.
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
- Entire Agreement: These Terms, together with our Privacy Policy and any applicable product-specific terms, constitute the entire agreement between you and EcoWestern.
Addendum A: California (CCPA/CPRA)
This addendum applies to California residents and supplements the main Terms and our Privacy Policy.
- We do not sell or share your personal information. EcoWestern does not sell personal information for money or other value, and does not share personal information with third parties for cross-context behavioral advertising (e.g., we do not run ad-tracking pixels or third-party ad SDKs).
- Categories of personal information we collect: identifiers (e.g., email, Economic ID), account and usage data, content you create or upload, device/technical data, and payment-related data (processed by Paddle as Merchant of Record; see Section 10).
- Purpose of collection: to operate and secure the Services, provide customer support, process payments, and comply with legal obligations. We do not use this data for advertising purposes.
- Your rights: You have the right to know what personal information we collect, request deletion, request correction, and request a portable copy of your data. Exercise these rights anytime at id.economic.net/id/outback, or contact privacy@ecowestern.net.
- Non-Discrimination: We will not deny you goods or services, charge different prices, or provide a different level of service because you exercised any CCPA right.
- Authorized Agents: You may designate an authorized agent to make a request on your behalf, subject to identity verification.
Addendum B: European Union / United Kingdom (GDPR)
This addendum applies to individuals located in the EEA, UK, or Switzerland and supplements the main Terms and our Privacy Policy.
- Data Controller: EcoWestern is the data controller for personal data processed in connection with your Economic ID and use of the Services, except where a specific product's terms state otherwise.
- Legal Basis for Processing: We process your personal data on the basis of (a) performance of our contract with you (providing the Services), (b) our legitimate interests (security, fraud prevention, service improvement), (c) legal obligation (e.g., tax, law enforcement requests), and (d) your consent where required (e.g., EcoBeta telemetry, optional AI training opt-in).
- International Transfers: Where our subprocessors transfer or process personal data outside the EEA/UK (including via edge infrastructure that may route through non-EEA/UK nodes), we rely on appropriate safeguards, including the EU Standard Contractual Clauses (SCCs) and the UK International Data Transfer Addendum, as applicable. A current list of subprocessors is available at status.ecowestern.net.
- Your Rights: You have the right to access, rectify, erase, restrict, or port your personal data, and to object to certain processing. Exercise these rights at id.economic.net/id/outback, or contact privacy@ecowestern.net.
- Complaints: You have the right to lodge a complaint with your local data protection supervisory authority.
